These terms and conditions apply to
all courses starting on or before 30th April 2010.
For all courses starting on or after 1st May
alternative terms and
conditions apply.
By completing and submitting a Gundog
Club training course booking form for a training
course that commences on or before the 30th April
2010, or paying the
full price or first instalment for a Gundog Club
training course that commences on or before the 30th
of April 2010, you agree to the following terms
and conditions of booking.
CONDITIONS OF BOOKING ACCEPTANCE
Booking forms: You must submit a course
booking form online or by post, in order for your
booking to go ahead.
The
booking form must be filled in by the person who
will be handling the dog during the course (or their
legal guardian if under 18 years of age) and
the handler (or their legal guardian) must indicate
their agreement to these terms and conditions.
Payments received without a booking form will result
in a reserved place, but no details of the course
location will be sent to the handler until they have
filled in a booking form as well.
CONFIRMATION OF ORDER /AVAILABILITY OF PLACES
1.
We will contact you
to confirm your booking once we have received your
full or first instalment payment and course booking
form. We aim to email all those placing online
bookings within two working days of receiving their
payment.
We will do our best to
indicate on each course details webpage immediately a
course is fully booked. If however, the course
is already full when we receive your booking, we
will contact you and refund any payment you have
made in full.
NON-REFUNDABLE BOOKING FEE
Please note that a booking fee is included in
every course place purchase. The booking fee of £48
+ vat (£56.40) is non-refundable, except as
described below, under the headings ‘cooling off’
and ‘cancellation by us’.
METHODS OF PAYMENT
Paying in full:
You
may choose to save money by paying for your course
in one single payment. If you choose this option,
your space will be reserved for you once we receive
your cleared payment.
Paying in two
instalments: If you choose to pay in two
instalments, your space will be reserved for you
once we receive your cleared first instalment
payment, conditional upon you paying your second
instalment on time.
i) Only students that
have paid both instalments in full will be provided
with details of where to find their course, and be
allowed to attend.
ii) Your first
instalment is a non-refundable deposit, unless
conditions are met under the headings 'cooling off'
and 'cancellation by us'
iii) Your second
instalment will fall due three weeks before the
start of your course. The responsibility for making
the payment deadline is yours
COOLING OFF PERIOD
You are entitled to a
seven day 'cooling off' period following your
booking to enable you to cancel if you wish. During
this time you may contact us to let us know that you
do not wish to continue with your booking, and we
will refund your payment in full. The following
conditions apply:
i) The cooling off
period ends at 5pm on the seventh day following your
booking. If you booked before 5pm, or at midnight on
the same day if you placed your booking between 5pm
and midnight UNLESS the course starts before this
time, in which case the cooling-off period ends at
the planned start time of the first session of the
course
ii) Your booking is
considered to have commenced when you make your
first payment, or submit a booking form, whichever
is the first.
iii) Cancellation during
the cooling off period should be made in writing to
'The Training Co-ordinator, The Gundog Club, Hearn
Farm, Spats Lane, Headley, Bordon, Hants GU35 8SU or
by emailing admin@thegundogclub.co.uk
NON-PAYMENT
If you fail to pay
your second instalment on time: the
Gundog Club may be unable to guarantee you a place
on the course. In addition:
i) You will not be
entitled to a refund of your first instalment
payment.
ii) We may relist and
resell your place.
iii) If we resell your
place, or cancel the course, within 21 days of the
planned start date, when you have not paid your
second instalment, you will not be entitled to
attend this or any alternative course without first
paying the full fee again.
If you pay the
second instalment after the due date has passed:
If we have already resold the space or cancelled the
course, we will attempt to find you a space on an
alternative course. The following conditions will
apply
i) If we cannot find an
alternative that you are happy with, we will refund
the second instalment in full within 7 working days
of your requesting the same.
ii) If we do not resell
your space, or cancel the course, you may reinstate
your booking by paying your second instalment in
full before the start of the course.
iii) If this payment
arrives less than 7 full working days before the
course start date, we cannot guarantee that you will
receive details of how and where to find your course
venue in time to attend the first session.
iv) In this instance the
Gundog Club cannot be held liable for you missing
the first session
CANCELLATION OR POSTPONEMENT BY US
Cancellation: We
reserve the right to cancel any course at our
discretion. Reasons for cancellation might
include (but are not limited to) courses where numbers are insufficient or a trainer is
indisposed. If we cancel a course
your payment including the booking fee will be refunded in full.
Postponement:
We reserve the right to postpone any course at
our discretion. Reasons for postponement might
include (but are not limited to) courses where numbers are insufficient or
where a trainer is
indisposed. If we postpone a course
we will refund your payment (including the booking
fee) in full or you may choose to keep your
place on the course at the re-assigned start date.
CANCELLATION BY YOU AFTER THE 'COOLING OFF' PERIOD
Cancellation by you (a) customers that have paid
in full in advance: Once your cooling off
period has ended, if you are unable to attend the
course and let us know no later than 21 days before
the start date of the course, we will refund your
payment, minus the non-refundable deposit of £48 +
vat (£55.20). We regret that we are unable to offer
refunds for cancellations made within 21 days of the
start date of a course..
Cancellation by you
(b) customers that have paid both instalments of the
'easy payment option':
Once your cooling off period has ended, if you are
unable to attend the course and let us know no later
than 21 days before the start date of the course, we
will refund your second instalment payment. We
regret that we are unable to offer refunds for
cancellations made within 21 days of the start date
of a course.
Cancellation by you (c) customers that have paid
the first instalment of our Easy Payment Option
only:
Customers that have paid
the first instalment of our Easy Payment Option
only: we regret that we are unable to offer refunds
for first instalment payments, once the cooling off
period has ended.
VIDEO AND PHOTOGRAPHY
Photographs taken by us:
Gundog Club staff may
occasionally take photographs during your classes.
We reserve the right to use these photographs for
publicity purposes. In each instance, we will
endeavour to inform you first, however, if you do
not wish photographs of yourself or your dog to be
used for this purpose, please inform the Gundog Club
office at the start of your course.
Photographs taken by your trainer:
At the end of your course,
we will ask your trainer to photograph any
successful test candidates together with their dogs
and rosettes. This picture may be published on
our website, and sent to other publications (such as
the shooting press) for them to consider printing,
together with the names of the handlers and dogs,
and details of the awards that the dogs achieved.
If you do not wish your image to be used for
this purpose, please do not stand in the photo! If
you are happy for your image to be used, but do not
wish your details to be printed, please inform the
Gundog Club office as soon as possible. Details may
be published or sent out as early as 4pm on the
first working day after the picture is taken.
Photographs taken by you:
If you wish to take
photographs of your own, during the course, please
ask permission from your trainer. Their decision is
final in this matter. If permission is granted,
please respect the wishes of any member of your
group who does not wish to be photographed.
Copyright and reproduction:
The Gundog Club expressly
forbids the right to reproduce any part of our
lessons in any form (e.g. on the internet, DVDs,
photographs etc). Anyone suspected of filming or
photographing the lessons for any purpose of
publication, without the written permission of the
Gundog Club management, will be asked to leave
the course.
Liability:
The Gundog Club cannot be
held liable for the actions of third parties, and
therefore excludes to the fullest extent possible by
law, any liability arising from a breach of this
section headed “Video and photography” by any party.
DOGS
Bitches on heat are not permitted on the
training courses without the written agreement of
the trainer. Such permission will only be
given if all the other dogs on the course are also
bitches. Please do not book a place on a
course during a period of time when you think your
bitch may come into season.
Behavioural problems: The trainer
has the right to exclude from his course any dog
which in the opinion of the trainer, has behavioural
problems which may interfere with the classes to the
detriment of other students and their dogs.
This includes but is not limited to, dogs
which are aggressive, or bark excessively, and dogs
which run away (no recall).
Health: All dogs attending the
course must be in good health and have up to date
vaccinations. The trainer may ask to see
evidence of vaccination status before allowing
access to his classes Please do not bring a
dog to the course which has been in contact with an
infectious disease within the previous 21 days.
STUDENTS
Disruptive behaviour: The trainer has the
right to exclude from his course any student who in
the opinion of the trainer, is behaving in such a
way as to interfere with the proper running of the
course, or with the rights of the other students on
the course to an enjoyable and educational
experience.
Health and fitness:
Gundog Club training takes place on rural sites.
Students need to be able to walk briskly, and may on
some sites need to climb or cross obstacles such as
ditches or stiles. Whilst some of our trainers may
be able to accomodate the needs of students with
some types of physical disability at their venue, we
cannot guarantee that this will be possible on any
given course. If you have some degree of
physical disability it is important that you contact
us in advance of booking a course place, so that we
can discuss the suitability of your chosen
location with you and your trainer.
Risk: Students take part in Gundog Club
training at their own risk. The Gundog Club,
and its Instructors are not responsible for
injuries, or for damage to personal effects or
clothing, sustained by students as a result of the
normal physical activity involved in gundog training
in rural locations. Some gundog training activities
will take place away from paths and tracks, and will
involve walking across uneven surfaces. In some
circumstances students may get wet and muddy, and
should dress accordingly.
Access to training sites and appropriate
behaviour on site: The Gundog Club training
usually takes place on private land. Access to this
land is provided with the permission of the
landowners and Gundog Club students must undertake
to respect this privilege at all times.
Students may not leave litter, damage crops,
or behave in way that so as to disrupt or damage the
landowner's property. Students must agree not to
divulge the access details of the training site to
any third party, nor to attempt to access the
training site at any time other than during an
agreed training session and in the company of the
Gundog Instructor with whom the course has been
booked.
